Genetic testing can be used to determine if unexplained fractures in children could have resulted from a predisposition to bone fractures, e.g., osteogenesis imperfecta. However, uncertainty is introduced if a variant of unknown significance is identified. Proper interpretation of VUS in these situations is critical because of its influence on clinical care and in court rulings. This study sought to understand how VUS are interpreted and used by practitioners when there is a differential diagnosis including both osteogenesis imperfecta and non-accidental (...) injury.A 15-question survey was emailed to physicians who requested analysis of two genes, COL1A1 and COL1A2, from the University of Washington from 2005-2013 for patient cases involving suspicion of child abuse.Among the 89 participants, responses differed about when genetic testing should be ordered for osteogenesis imperfecta, who should be consulted about utilization of VUS test results, follow-up procedures, and who should receive the VUS results.There are no clear guidelines for how to interpret and follow up on VUS. In the legal setting, misinterpreted VUS could lead to unintended consequences and deleterious ramifications for family members. The need for better practice guidelines to help promote more equitable handling of these sensitive legal cases is clear. (shrink)

The essential nature of legislative power is to make the laws; that of executive power is to execute those law. The difference between the two is both substantial and significant; it is the difference between the rule of arbitrary power and the rule of law. This paper will seek to trace the genesis of an independent judicial power, in both theory and practice, through an examination of sections of The Constitutions of Clarendon, The Assize of Clarendon, Hobbes’ Leviathan, Locke’s Second (...) Treatise, Montesquieu’s Spirit of the Laws, as well as The Federalist Papers. Moreover, it will seek to establish its executive nature and to explain why it is so often (at least presently) misunderstood to be akin to the legislative power. (shrink)

Consistent with Ruchkin and colleagues' proceduralist account, recent research on grouping and verbal-spatial binding in immediate memory shows continuity across short- and long-term retention, and activation of classes of information extending beyond those typically allowed in modular models. However, Ruchkin et al.'s account lacks well-specified mechanisms for the retention of serial order, binding, and the control of activation through attention.

This book provides a compositional, truth-conditional, crosslinguistic semantics for evidentiality, the linguistic encoding of the source of information on which a statement is based. Central to the proposed theory is the distinction between what propositional content is at-issue and what content is not-at-issue. Evidentials contribute not-at-issue content, and can affect the level of commitment a sentence makes to the main proposition, contributed by sentential mood. In this volume, Sarah Murray builds on recent work in the formal semantics of evidentials (...) and related phenomena, and proposes a semantics that does not appeal to separate dimensions of illocutionary meaning. Instead, she argues that all sentences make three contributions: at-issue content, not-at-issue content, and an illocutionary relation. At-issue content is presented and made available for subsequent anaphora, but is not directly added to the common ground; not-at-issue content directly updates the common ground; and the illocutionary relation uses the at-issue content to impose structure on the common ground, which, depending on the clause type, can trigger further updates. 0The analysis is supported by extensive empirical data from Cheyenne, drawn from the author's own fieldwork, as well as from English and a variety of other languages. It is commonly supposed that metaphysical modal claims are to be evaluated with respect to a single domain of possible worlds: a claim is metaphysically necessary just in case it is true in every possible world, and metaphysically possible just in case it is true in some possible world. We argue that the standard understanding is incorrect; rather, whether a given claim is metaphysically necessary or possible is relative to which world is indicatively actual. We motivate our view by attention (...) to discussions in Salmon 1989 and Fine 2005, in which various data are taken to support rejecting the transitivity of accessibility and modal monism ; we argue that relativized metaphysical modality can accommodate these data compatible with both standard modal logic and modal monism. Noting an analogy with two-dimensional semantics, we argue that metaphysical modality has a complex structure, reflecting what is counterfactually possible, relative to each indicatively actual world. In arguing for the need for relativization, we are broadly on the same side as Crossley and Humberstone and Davies and Humberstone ; our contribution here is, first, to offer distinctively metaphysical reasons for relativization, and second, to show that relativization can be incorporated in ways minimally departing from standard modal logic. Consider the following situation. It is the first day of school, and the new third-grade students file into the classroom to be shown to their seats for the coming year. As they enter, the third-grade teacher notices one small boy who is particularly unkempt. He looks to be in desperate need of bathing, and his clothes are dirty, torn and tight-fitting. During recess, the teacher pulls aside the boy's previous teacher and asks about his wretched condition. The other teacher informs (...) her that he always looks that way, even though the boy's family is quite wealthy. The reason he appears as he does, she continues, is that the family observes an odd practice according to which the children do not receive many important things – food, clothing, bathing, even shelter – unless they specifically request them. Since the boy, like many third-graders, has little interest in bathing and clean clothes, he just never asks for them. (shrink)

_Berkeley _was first published in 1982. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. In contemporary philosophy the works of George Berkeley are considered models of argumentative discourse; his paradoxes have a further value to teachers because, like Zeno's, they challenge a beginning student to find the submerged fallacy. And as a final, triumphant perversion of Berkeley's intent, his central contribution is still commonly (...) viewed as an argument for skepticism - the very position he tried to refute. This limited approach to Berkeley has obscured his accomplishments in other areas of thought - his account of language, his theories of meaning and reference, his philosophy of science. These subjects and others are taken up in a collection of twenty essays, most of them given at a conference in Newport, Rhode Island, commemorating the 250th anniversary of Berkeley's American sojourn of 1728–31. The essays constitute a broad survey of problems tackled by Berkeley and still of interest to philosophers, as well as topics of historical interest less familiar to modern readers. The mature Leibniz frequently uses the phrase “moral necessity” in the context of discussing free choice. In this essay I provide a seventeenth century geneology of the phrase. I show that the doctrine of moral necessity was developed by scholastic philosophers who sought to retain a robust notion of freedom while purging bruteness from their systems. Two sorts of bruteness were special targets. The first is metaphysical bruteness, according to which contingent events or states of affairs occur without a sufficient (...) explanation. The second is semantic bruteness according to which a proposition can be true without a truth maker. Denying eithersort of bruteness was thought by some to raise problems for freedom. Defenders of moral necessity thought the notion solved these problems without having to invoke bruteness. (shrink)

This paper presents a computer model of cortical broadcast and competition based on spiking neurons and inspired by the hypothesis of a global neuronal workspace underlying conscious information processing in the human brain. In the model, the hypothesised workspace is realised by a collection of recurrently inter-connected regions capable of sustaining and disseminating a reverberating spatial pattern of activation. At the same time, the workspace remains susceptible to new patterns arriving from outlying cortical populations. Rationale, aims and objectives : Evidence-based medicine (EBM) claims to be based on 'evidence', rather than 'intuition'. However, EBM's fundamental distinction between quantitative 'evidence' and qualitative 'intuition' is not self-evident. The meaning of 'evidence' is unclear and no studies of quality exist to demonstrate the superiority of EBM in health care settings. This paper argues that, despite itself, EBM holds out only the illusion of conclusive scientific rigour for clinical decision making, and that EBM ultimately is unable to fulfil its (...) own structural criteria for 'evidence'. Methods : Our deconstructive analysis of EBM draws on the work of the French philosopher, Jacques Derrida. Deconstruction works in the name of justice to lay bare, to expose what has been hidden from view. In plain language, we deconstruct EBM's paradigm of 'evidence', the randomized controlled trial (RCT), to demonstrate that there cannot be incontrovertible evidence for EBM as such. We argue that EBM therefore 'auto-deconstructs' its own paradigm, and that medical practitioners, policymakers and patients alike ought to be aware of this failure within EBM itself. Results : EBM's strict distinction between admissible evidence (based on RCTs) and other supposedly inadmissible evidence is not itself based on evidence, but rather, on intuition. In other words, according to EBM's own logic, there can be no 'evidentiary' basis for its distinction between admissible and inadmissible evidence. Ultimately, to uphold this fundamental distinction, EBM must seek recourse in (bio)political ideology and an epistemology akin to faith. (shrink)

Some have argued that advances in the science of human decision-making, particularly research on automaticity and unconscious priming, would ultimately thwart our commonsense understanding of free will and moral responsibility. Do people interpret this research as a threat to their self-understanding as free and responsible agents? We approached this question by seeing how feelings of surprise mediate the relationship between personal sense of control and third-personal attributions of free will and responsibility. Across three studies (_N_ = 1,516) we found that (...) people with a greater sense of personal control were more surprised at the results of experiments showing effects of unconscious priming on moral behavior. Surprise differentially mediated the relationship between personal control and attributions of free will and responsibility: people attributed _less_ free will and _more_ responsibility as they were more surprised. This suggests that people exhibit defensive thinking with respect to responsibility, but not free will. (shrink)

There is a nationwide resurgence of tuberculosis in the country’s urban centers; New York City stands at the forefront of this resurgence. The root causes are increased homelessness, drug addiction and poverty, all symbols of deteriorating social and economic conditions in the city. The inadequate level of public health resources devoted to TB has also contributed to its spread. Still, even with these factors, it is questionable whether the escalating number of TB cases in this country would have occurred without (...) the reservoir of immunosuppressed persons, who are less resistant to the disease, created by the AIDS epidemic. The fear and urgency of this public health crisis, which has been emerging since the beginning of the last decade, are fueled by the rise of TB strains resistant to the first-line drugs and by the disease’s contagiousness. Eliciting negative stereotypes about ageing commonly results in worse performance on many physical, memory, and cognitive tasks in adults aged over 65. The current studies explored the potential effect of this “stereotype threat” phenomenon on older adults’ emotion recognition, a cognitive ability that has been demonstrated to decline with age. In Study 1, stereotypes about emotion recognition ability across the lifespan were established. In Study 2, these stereotypes were utilised in a stereotype threat manipulation that framed an emotion recognition task (...) as assessing either cognitive ability, social ability, or general abilities. Participants then completed an emotion recognition task in which they labelled dynamic expressions of negative and positive emotions. Self-reported threat concerns were also measured. Framing an emotion recognition task as assessing cognitive ability significantly heightened older adults’ reports of stereotype threat concerns. Despite this, older adults’ emotion recognition performance was unaffected. Unlike other cognitive abilities, recognising facially expressed emotions may be unaffected by stereotype threat, possibly because emotion recognition is automatic, making it less susceptible to the cognitive load that stereotype threat produces. My discussion has four parts. In section 1, I reconstruct Leibniz’s early position on freedom and show how various problems motivated significant changes in Leibniz’s views over a short period of time. In section two, I outline a series of notes by Leibniz entitled “De Libertate a Necessitate in Eligendo,” where Leibniz develops a rudimentary theory of contingency that resembles the infinite analysis theory developed around 1686. In section three, I consider some reasons for why Leibniz dropped the “Eligendo” view. (...) In section four, I look at the link that Leibniz develops between an infinite series of reasons and indemonstrability and suggest how the rudimentary theory of “Eligendo” eventually became the infinite analysis theory of contingency. This journal article reflects on the conceptualization of a three-day meeting convened to open space for thinking differently about the city of Johannesburg, South Africa, and to begin to explore the possibility of working beyond the constraints of standard urban studies and regimes of spatial planning through which the city is conventionally viewed and researched. The incentive underpinning the 2015 Performative Urbanisms workshop was the desire to find areas of correspondence and overlap in the often widely separated realms of scholarly (...) research and grassroots urban activism. To this end, a group of international and Johannesburg-based academics, writers, artists, analysts, and activists came together to explore a range of themes around the city and its visual, spatial, textual, and especially performative, representations, in the context of its functioning as a global city in comparative perspective. As the contents of this Special Issue show, the workshop provided space to consider diverse research methodologies, creative writings, and artistic strategies aimed at moving beyond formulaic constructs of Johannesburg, and instead to offer an accounting of its novelties, complexities, and originalities. The belief that God responds to prayer is widespread. According to a recent Newsweek survey 87% of Americans said that they believe that God answers prayers. In fact, they believe so heartily in the efficacy of prayer that nearly one third of those polled said that they prayed to God more than once a day. What is even more interesting about this belief among ordinary Americans is that it has been denied by so many theologians. One might think such denials (...) would be found only among contemporary liberal theologians who deny that miracles are possible or that God would deign to interfere in human affairs. But in fact, such denials can be found in the writings of the founding fathers of many religious traditions. Of course, these theologians do not thereby deny that prayer is important or meaningful. Instead, the argue that it is meaningful because it brings about certain internal, psychological benefits for the petitioner. (shrink)
